the law says if it's under 50cc's, cannot exceed 30mph, and is automatic it's a moped. my derbi gpr is 50cc's goes about 70-75mph and is 6 speed manual shift..what should it be classified as, a motocycle or a moped? will they have to put it on a dyno to re-classify it? should i mod the cylinder and piston to more than 50cc's so it's not so borderline and then have it checked out?

I don't get it either. Here in California, the only way it can be considered a moped is if it has pedals. What is a moped without pedals?!? The derbi is classified as a "motor driven cycle" since it is under 150cc, therefore not allowed on the highway. I don't understand how states can consider a scooter or a small motorcycle a "moped" if it doesn't have pedals.



I wouldn't worry about it being considered a moped. You only have to pay one time for a moped registration where as everything else has an anual renewal. It's also much cheaper to register it and insurance is much less as well. I guess cops can give you trouble if they see you riding over 30 mph on your "moped" but as long as you're obeying the law and the posted limits, tough. Good luck with that.

I'm guessing its not a moped, dude. You've gotten more points against than for calling it a moped. A moped is generally something thats really slow and small (read boring ;-) ).

The derbi site says it's 49.9 cc. That probably doesn't help though.
