No, if EMT has revived the biker, then they are still alive.

The person wouldn't be truly dead until pronounced dead by a medical professional. If an EMT/Paramedic arrived on scene and found an injured victim that they thought was savable, they wouldn't call them dead. If a victim has no signs of life, they can still try to revive that person, and if they do try, they will not pronounce that person dead. The EMT/Paramedic will continue until the victim is at the hospital where a doctor can pronounce them dead. Conversely, if an EMT/Paramedic arrives on scene and they think a victim is dead, they will not try to revive them.

So, to answer your question, no the person would not be considered dead then alive. So, no the driver wouldn't be convicted of manslaughter if the patient didn't die.

definitely not. if the person is killed because of the accident, then it is vehicular manslaughter, but it would only be considered that if it was an accident that could have been avoided. unless the prosecutors are sons of guns, then you're screwed!
