the title should tell you. although it is true that the person with the lien shouldn't have the title its real easy to go to the dmv and request a new title...but even a new title will list a lien. Sometimes a lien is listed on a title but its a matter of the title being the original. If there is a lien the bank that holds it will be listed and you can call them and get a lien release to clear things up in a worst case scenario. If your waiting for a new title give the VIN number to the DMV and they can tell you if it has a lien or not in most cases.

If it has a lien on it the owner will not have the title, it is held by the lienholder until it is payed off.

It will show the seller as "registered" owner and "SO-n-SO Bank" as "legal" owner. When the buyer pays off the loan, the lender will put a rubber-stamped signature on it and mail it them (owner) he can then sell it legally. If the legal owner section is blank, there is no lien.

It depends on the state in which the title is issued. In New York, the leinholders will be listed on the bottom of the title, which is held by the owner of the vehicle.
